Terms of service
Last updated 27 September 2026
These terms explain the rules for using Get Stoked: what we provide, what we expect from you, and how creator programmes, tracking and AI features work.
1. About these terms
These terms are an agreement between you and [Your full name], a sole trader based in the United Kingdom, trading as Get Stoked, of [Business postal address] (“Get Stoked”, “we”, “us”). By creating an account or using Get Stoked you agree to them.
If you use Get Stoked for a business (for example as a brand running a creator programme), you confirm you can bind that business to these terms, and “you” means the business. Our Privacy policy and Cookie policy explain how we handle personal information.
2. Your account
- You must be 18 or over to create an account.
- Give us accurate information and keep it up to date, keep your password safe, and tell us straight away if you think someone else has used your account. You’re responsible for what happens in your account.
- A creator account is for one person. A brand account can have several team members.
3. Plans, usage and payment
Every plan includes every feature. Plans differ by how many page views are tracked and how many AI launch campaigns you can generate each month, as shown on our Pricing page.
Paid plans aren’t available yet, so every account is on the Free plan. Before usage limits or charges start we’ll give you at least 30 days’ notice, and we’ll never charge you without your agreement.
If you go over your plan’s page views, we keep tracking. You’ll see data up to your allowance, and the rest becomes visible if you upgrade. Data over your allowance is kept for 90 days. When your AI allowance is used up, new AI generations wait until next month or until you upgrade.
When paid plans launch: plans are billed in advance, you can cancel at any time and keep your plan until the end of the period you’ve paid for, and prices may change with at least 30 days’ notice.
4. Your content and data
You own the content and data you put into Get Stoked, including your analytics data, programme terms and campaign content. You give us permission to host, copy, process and display it only as needed to provide and improve the service for you.
You can ask us to export or delete your data, or to close your account, at any time by emailing hello@stoked.tech. After an account is closed we delete its data within 30 days, except where the law requires us to keep it.
5. Tracking on your websites
If you add the Get Stoked tracking script to a website, you are responsible for:
- telling your visitors about it in your own privacy notice, and
- getting their consent where the law requires it (in the UK and EU this usually applies, because the script stores an ID in the visitor’s browser). Our consent mode (
data-consent="required") stops the script recording or storing anything until your consent banner allows it.
Only track websites you own or are authorised to manage, and don’t send us special category data (such as health information) or information that directly identifies visitors in page addresses or conversion details.
6. Creator programmes
- A creator programme is an arrangement between a brand and its creators. Get Stoked provides the tools and tracking; we are not a party to that arrangement.
- Brands pay creators directly. Get Stoked does not hold, move or guarantee any money. Earnings shown in Get Stoked are calculations based on tracked activity and the terms the creator accepted; the brand is responsible for paying what it owes under those terms.
- Brands decide who can join a programme and can remove or block a creator at any time. Changes to programme terms need the creator’s acceptance and don’t apply to earnings from before they take effect.
- Creators and brands must follow advertising disclosure rules (for example labelling paid promotion with #ad under UK CAP/ASA rules or the US FTC guides) and the rules of the platforms they post on.
- Tracking can be affected by ad blockers, browser privacy features and visitors who decline consent, so tracked results may not capture every visit or sale.
7. AI features
- AI-generated content can be wrong, incomplete or unsuitable. Review it before you publish it; you are responsible for what you publish.
- Only ask us to analyse web pages you’re allowed to use, and don’t put content in a brief that you don’t have the right to use.
- If you use your own AI provider key (when available), we use it only for your own work, and you are responsible for your account with that provider.
8. Acceptable use
You must not use Get Stoked to:
- break the law or infringe anyone’s rights;
- send spam, or create tracked links or QR codes that mislead people, lead to phishing, malware or illegal content;
- inflate results with fake visits, clicks or conversions, bots, or self-referrals;
- try to access other customers’ data, test or break our security without permission, or overload the service;
- copy, resell or reverse-engineer the service, except as the law allows.
9. Third-party services
Some features connect to services we don’t control, such as social platforms and AI providers. Your use of them is also covered by their own terms, and features that depend on them may change or stop if those services change.
10. Data processing terms
This section applies when we process personal data on your behalf: data about visitors to your websites and contacts you store in Get Stoked. You are the controller and we are your processor. We will:
- process that data only to provide the service and on your documented instructions (these terms and your use of the service), unless the law requires otherwise;
- make sure anyone who processes it is bound by confidentiality;
- keep it secure with appropriate technical and organisational measures;
- use only the sub-processors listed in our Privacy policy, tell you before adding or replacing one (you may object), and hold each to the same data protection obligations;
- help you respond to people exercising their rights and with your security, breach-notification and impact-assessment obligations;
- tell you without undue delay after becoming aware of a personal data breach affecting your data;
- delete it (or return it, if you ask) when you close your account, unless the law requires us to keep it; and
- give you the information needed to show we meet these obligations and allow reasonable audits.
The data covers page views, referrers, campaign tags, browser user agents, anonymous visitor IDs, creator codes, visitor country and conversion details, and any contacts you add, about your website visitors and contacts, kept as described in our Privacy policy. Where data is transferred outside the UK or EEA, the safeguards in our Privacy policy apply.
11. Changes to the service and availability
We work to keep Get Stoked available and reliable, but we don’t promise it will always be available or error-free, especially on the Free plan. We may change or improve features; if we remove something important you rely on, we’ll give you reasonable notice.
12. Suspension and closing accounts
You can close your account at any time. We may suspend or close an account that breaks these terms, puts the service or other users at risk, or that the law requires us to act on. Where it’s reasonable, we will warn you first and give you a chance to export your data.
13. Liability
Nothing in these terms limits liability that can’t be limited by law, such as for death or personal injury caused by negligence, or fraud. If you are a consumer, you keep your statutory rights.
Otherwise, we aren’t liable for loss of profit, revenue, business or goodwill, or for indirect or consequential losses. Our total liability to you in any 12 months is limited to the greater of the amount you paid us in that period and £100.
If you use Get Stoked for a business, you’ll cover our reasonable losses from claims by third parties caused by your content, your creator programme terms or your breach of these terms.
14. Changes to these terms
We’ll give you at least 30 days’ notice of important changes by email or in the app. If you don’t agree, you can close your account before they take effect.
If Get Stoked becomes a company, we may transfer these terms and your account to it. We’ll tell you before that happens; your rights under these terms won’t be reduced by the transfer.
15. Governing law
These terms are governed by the law of England and Wales, and its courts have jurisdiction. If you are a consumer living elsewhere in the UK or EU, you can also bring proceedings where you live and keep the protection of your local laws.
